Acceptance of Terms

By accessing or using AppDown ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these terms at any time. Material changes will be communicated through a notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified terms.

If you access the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Permitted Use

AppDown grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may download APK files for use on devices you own or control, browse our content, and access our blog and informational resources.

You agree not to: use the Service for any illegal purpose or in violation of any laws; attempt to gain unauthorized access to our systems or other users' accounts; interfere with the proper functioning of the Service; use automated tools to scrape or download content in bulk; redistribute APK files we provide without explicit permission from the original developers; remove or alter copyright notices, trademarks, or other proprietary notices.

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or our business interests.

Intellectual Property

All content on AppDown including text, graphics, logos, images, and software, is the property of AppDown or its content suppliers and is protected by international copyright laws. The compilation of all content on this site is our exclusive property. The Service may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for commercial purposes without our express written permission.

APK files distributed through AppDown remain the intellectual property of their respective developers and copyright holders. We host these files for distribution but claim no ownership over the apps themselves. Your use of any downloaded app is subject to the terms and license agreements of the original developer.

Trademarks, logos, and brand names appearing on the Service belong to their respective owners. Their use does not imply endorsement or affiliation between us and those owners.

Disclaimers

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included on it. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. While we perform extensive verification of APK files, we cannot guarantee that any specific APK is suitable for your particular use case or compatible with your specific device.

You are responsible for backing up your device data before installing any APK file. We are not liable for data loss, device malfunction, or other damages resulting from your use of downloaded apps.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AppDown, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of the Service.

Our total liability for any claim arising out of or relating to these terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars (USD 100), whichever is greater. This limitation applies regardless of the legal theory under which the claim arises.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so the above limitations may not apply to you in full.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AppDown operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

You agree that any cause of action you may have arising out of or related to the Service must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
